“Samsung True North Tunes” Contest
1. Entry Date
The Contest entry period begins at 12:00:01 a.m. Eastern Standard Time (“EST”) on Friday, March 20, 2026 and ends at 11:59:59 p.m. EST on Sunday, May 31, 2026 (“Contest Entry Period”). The Contest will be divided into three (3) phases, as outlined in Section 4 of these Contest Rules.
2. Eligibility
The Contest is open only to legal residents of Canada who are nineteen (19) years of age or older and who are not currently signed to a music label and/or publisher (either as an individual artist, as a member of a Band (defined below) or any other form of musical group) . Employees of the Sponsors, not-for-profit organizations that are supporting the Sponsor with the promotion, and each of their respective parents, affiliates, subsidiaries, advertising and promotion agencies, retailers, distributors and suppliers (collectively the "Contest Entities"), and the immediate families (spouse, parents, children and siblings and their respective spouses, regardless of where they reside) and individuals living in the same households of any of the foregoing individuals, whether or not related, are ineligible to participate or win a prize. The Contest is subject to all applicable federal, provincial and local laws and regulations.
For the purposes of this Contest, you can enter as: (i) an individual; or (ii) as part of a group (a “Band”) consisting of two (2) or more eligible participants. The same eligible individual cannot: (i) register as both an individual and as part of a Band; and/or (ii) be a member of more than one (1) Band. To you participate as a Band, your Band must designate one (1) eligible Band member to submit all required information in the Contest (a “Representative”). Such Representative must have the unencumbered authority, authorization and permission from the other member of the Band (during the Contest Period, at the time of participation and prize fulfillment) to: (i) upload the submission and provide to Sponsor any and all other required information that relates to the Band member for the purposes of administering the Contest in accordance with these Rules; (ii) participate in the Contest on behalf of the Band member; (iii) grant to Sponsors, on behalf of the Band member, all rights, permissions and authorizations set out under these Rules; and (iv) legally bind the Band member – including, without limitation, to these Rules and to any other required documentation as contemplated in these Rules.
By entering the Contest, each participant (whether entering as an individual or as a member of a Band) hereby understands, acknowledges and agrees:
- that they have read, understood, and agree to be bound by the Official Contest Rules & Regulations;
- that the Music Performance (defined below) including the video and the master recording and composition contained therein and any other materials submitted (collectively, the ”Submission”) is wholly original to the Eligible Participant (and if applicable, to the Band) and the Eligible Participant has obtained all necessary rights in and to the Submission including, without limitation, the express written consent from every member of the Band and any other identifiable person who appears in the Music Performance); and
- that they have read, understood and agreed to the collection of their personal information, in accordance with Samsung’s Privacy Policy.
IMPORTANT GRANT OF RIGHTS – By entering the Contest each eligible participant (on their own behalf and if applicable, on behalf of all members of the Band) grant to Samsung and all other Contest Entities (and any other party authorized by the Contest Parties), the limited, fully paid up, royalty free, Canadian rights, license and permission, for a period of two (2) years to reproduce, copy, publish, broadcast, disseminate, display, and cut down for promotional material, make available, synchronize with other content and materials, communicate to the public, on all media, and otherwise use, all content and material created, provided, submitted or furnished by the participant (and if applicable, a Representative and/or member of the Band) in connection with this Contest, including, without limitation, each participant’s Submission, Music Performance and Live Performance Video (collectively, the “Contest Materials”). For clarification, ownerships rights to the Music Performance and Live Performance will belong solely to the Participant.
Participants who adhere to the criteria in this Section 2 of the Contest Rules shall be referred to as “Eligible Participants” or “Artists”.
3. General Conditions
PRIZE NOTE: All “Prizes”, defined as the Top 100 Finalist Prizes, Top 20 Finalist Prizes, and Grand Prizes as defined in these Contest Rules, will be awarded to the winning Artists. Winning Artists will be responsible for all taxes, if any (including federal, provincial and local taxes) and other costs and expenses associated with the acceptance and use of a Prize (or any portion thereof) not included with the prize as awarded.
All Prizes awarded pursuant to this Contest are awarded “as is” with no warranty or guarantee, either express or implied, by Sponsors except for any manufacturer’s warranty accompanying the Samsung products. Selected contestants/finalists/winners may not substitute, assign or transfer Prize or redeem Prize for cash, but Sponsors reserve the right, at its sole discretion, to substitute the Prize (or any portion thereof) with one of comparable or greater value (as determined by the Sponsors in its sole and absolute discretion). Many of the Prizes do not have a corresponding approximate retail value (“ARV”) as the Prize is an experiential opportunity that is not commercially available and has no established market value. Where the ARV of a Prize is indeterminate due to its experiential nature, the Sponsors will make best efforts to provide a prize of a similar nature and quality, as determined in their sole and absolute discretion and in the event that the Sponsors cannot award a prize of similar nature and quality, the Sponsors shall select an alternate prize in their sole and absolute discretion.
Prizes will be awarded to the selected contestants and Representatives for the benefit of the applicable selected contestants/finalists/winners. Selected contestants/finalists/winners will be responsible for any expenses associated with acceptance and use of the prize except as expressly stated in these Official Rules. All Prize details are at the sole discretion of the Sponsors.
Notwithstanding anything contained herein, Sponsors reserve the right to not award all Prizes or advance fewer entries for any phase of the Contest if, in its sole discretion, it determines it has not received a sufficient number of qualified eligible entries.
IF YOU ARE A SELECTED CONTESTANT/FINALIST/WINNER, YOU MUST, BEFORE BEING DECLARED A WINNER OR ELIGIBLE TO PROCEED TO SUBSEQUENT ROUNDS OF THE CONTEST: (i) Agree to and sign the Artist Submission and License Agreement as provided to you by the Contest Entities which, among other things: (a) confirms the grant of rights to Samsung and to any other party authorized by Samsung with respect to the Submission, as set out above; (b) releases the Released Parties from any and all liability in connection with this Contest and/or Samsung’s (and any party authorized by Samsung) use of the Submission; (c) agrees to indemnify the Released Parties against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her application information or any portion(s) thereof and/or from their participation in the Contest or any portion(s) thereof; and (d) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest or TNT and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsors in perpetuity throughout the world in any manner or medium whatsoever, including print, broadcast or the internet; (ii) correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill testing question; (iii) complete all required forms and contracts provided as necessary by the Sponsors in regards to the different Prizes as the detailed in these Contest Rules, and (iv) in the Sponsors’ sole discretion, execute and deliver to the Sponsor within the time specified by the Sponsor the “Waiver”, confirming your compliance with these Rules, acceptance of the applicable prize as awarded without substitution, and releasing the Sponsors, its affiliates and related third parties, advertising and promotional agencies, and each of their respective shareholders, directors, officers, employees, agents, dealers, representatives, successors and assigns (collectively the “Released Parties”) from any liability in connection with this Contest, your participation therein and/or the awarding and use/misuse of the applicable prize or any portion thereof. All required documents must be executed and returned prior to receiving a prize.

Music Submission
For this Contest, Eligible Participants are required to submit a wholly original song and music performance in video format that is solely the property of the Artist and does not belong to any recording company or music distributor (the “Music Performance”).

All information inputted into the Entry Form including the Music Performance shall be referred to as “Participant-Generated Content” or “Entry” herein.
Before submitting the Entry Form, Eligible Participants must accept and check off the following disclosures:
- I have read, understood, and agree to be bound by the Official Contest Rules & Regulations.
- The song (including the master recording and the composition), the video, and any other materials that I have submitted (collectively, my “Submission”) is wholly original to me (and if applicable, to my band) and I have has obtained all necessary rights in and to my Submission including, without limitation, the express written consent from every member of the band and any other identifiable person who appears in the video).
- By clicking, I (on my own behalf and, if applicable, on behalf of all members of the band) grant to Samsung and to any other party authorized by Samsung, the limited, fully paid up, royalty free, Canadian rights, license and permission, for a period of two (2) years to reproduce, copy, publish, broadcast, disseminate, display, and cut down for promotional material, make available, synchronize with other content and materials, communicate to the public, on all media, and otherwise use, all content and material created, provided, submitted or furnished by the participant (and if applicable, a Representative and/or member of the Band) in connection with this Contest, including, without limitation, each participant’s Submission, Music Performance and Live Performance Video (collectively, the “Contest Materials”). For clarification, ownerships rights to the Music Performance and Live Performance will belong solely to the Participant.

Your Music Performance will be judged in accordance with the specifications set out below to determine which Participants will advance to Phase Two of the Contest.
Requirements for your Participant-Generated Content:
Participant-Generated Content may not contain, as determined by the Sponsor, in its sole discretion, any content that:
- Is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, orientation, identity, religious, professional or age group; profane or pornographic; contains nudity;
- Promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
- Is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other video submission;
- Defames, misrepresents or contains disparaging remarks about other people or companies;
- Contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others;
- Contains any personal identification, such as but not limited to personal names or e-mail addresses;
- Contains copyrighted materials owned by others (including music, photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media);
- Contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;
- Contains look-alikes of celebrities or other public or private figures, living or dead;
- Communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or
- Violates any law.
Each Submission must be the original work of each Eligible Participant, may not have been previously published, and may not have won previous awards or selected as a winner in any other contest. If the Entry contains any individuals other than the Eligible Participant or Band, the Eligible Participant is responsible for obtaining, prior to submission of the Music Performance, any and all releases and consents necessary to permit the use and exhibition of the Music Performance by Sponsors in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the video (and, if a minor appears in or is identifiable in the Music Performance, from such minor’s parent/legal guardian). Sponsors reserve the right to request proof of these permissions in a form acceptable to Sponsors from any finalist at any time. Failure to provide such proof may render such Entry disqualified from the Contest. By submitting a Submission, each finalist warrants and represents that they and any persons appearing or who are identifiable in the Music Performance consent to the submission and use of the Music Performance in the Contest and to its use as set forth herein.
By submitting the Submission, each Eligible Participant acknowledge and agree that the Released Parties do not now or in the future have any duty or liability, direct or indirect, vicarious, contributory or otherwise, with respect to the infringement or protection of any copyright in and to any video submission. Sponsors and their designees shall have the right to edit, publish, use, adapt, reproduce, exploit, modify or dispose of any Entry and all elements of such Entry, online (including on Social Media), in print, film, television, or in any other media now or hereafter known throughout the world.
Each Live Performance submitted will be judged based on the criteria set out below to determine which entry or entries will be chosen a winner.
All Phase One entries must be received by 11:59:59 p.m. EST on Sunday, May 31st, 2026 to be considered. Entries will only be accepted in English or French, answers to all questions must be in the form of a statement, and only fully completed entries will be accepted and eligible for entry into the Contest. The decisions of the judges are final and legally binding in all matters relating to this Contest. Limit one (1) Entry per Eligible Participant and their band/group if applicable during Phase One. If multiple Entries are received from the same person or band/group if applicable utilizing multiple email addresses, the judges may use their discretion to select the entry submission and or disqualify the Participant from participation in this Contest. Proof of submitting an entry does not constitute proof of delivery. Entries that are in any way fraudulent, illegible, altered, mutilated or tampered with, in the sole discretion of the Sponsor, will be declared invalid. All Entries become the property of Sponsor #1 and will not be acknowledged or returned. Entry must be Eligible Participant’s own original work, be true and verifiable, may not be offensive or inappropriate and may not contain profanities or obscenities nor depict Contest Entities unfavorably, as determined by the Sponsors in their sole discretion. Entries must be consistent with the images of the Contest Entities and must not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights. Sponsors reserve the right in its sole discretion to disqualify any entry it determines does not comply with these requirements or these Official Rules, in its sole discretion.
BY SUBMITTING AN ENTRY, YOU AGREE THAT THE INFORMATION IN YOUR RESPONSES COMPLIES WITH ALL CONDITIONS STATED IN THESE OFFICIAL RULES. THE RELEASED PARTIES (WILL BEAR NO LEGAL LIABILITY, EXPRESSED OR IMPLIED, REGARDING THE USE OF THE INFORMATION BY THE SPONSORS. THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THE OFFICIAL RULES.
B) Phase One Judging and Judging Criteria:
Every eligible Entry received during the Contest Entry Period will be judged based on the criteria set out below by a panel of qualified judges selected by the Sponsors. The judging panel will consist of 5-7 judges who will be both Sponsor #2 judges and qualified individuals of Sponsor #2’s partners as chosen by Sponsor #2. Entries will be saved electronically as part of a Zip folder and Excel file provided to all judges for individual grading using a scorecard in accordance with the criteria set out below. Judging will begin Monday, June 1, 2026 at 1:00 pm EST will conclude on Sunday, July 5, 2026 at 11:59:59 pm EST and be based on the following criteria:
- Artistic Identity
- Unique Sound
- Regional Buzz
- Genre and Diversity
- Visuals and Aesthetic
- Marketability
Each criteria category is scored out of 5, with a maximum total of 30 points available. Subject to verification of eligibility and compliance with these Official Rules, one hundred (100) entries with the highest scores will be deemed Finalists (the "Top 100 Finalists") and will advance to Phase Two (see subsection II in this Section 3 for Phase Two details). In the event of a tie, a “tie- breaking” judge (who will be selected by the Sponsors in their sole and absolutely discretion) will determine which Entry will be deemed to have obtained the higher score from the above stated criteria from among all tied Entries.
C) Phase One Prizing: Finalists
There are a total of one hundred (100) Finalist prizes (each a “Top 100 Finalist Prize”) available to be won.
Each Top 100 Finalist will win a Top 100 Finalist Prize as listed in the table below (the ARV of all components of the Finalist Prize that do not have a corresponding ARV set out below are indeterminate):

Travel and accommodations are NOT included with any Top 100 Finalist Prize. EACH TOP 100 FINALIST will also be responsible for obtaining his or her own travel documentation. EACH TOP 100 FINALIST must be available to travel on the dates assigned by the Sponsors for the live performance prize or the live performance prize will be forfeited IF THE TOP 100 FINALIST IS NOT ABLE TO TRAVEL ON THE DATES ASSIGNED BY THE SPONSORS. The Top 100 Finalist Prizes must be accepted as awarded without substitution and is not transferable, not for resale and has no cash surrender value. In the event that the Top 100 Finalist does not use any portion of the Top 100 Finalist Prize, there will be no extension, transfer, substitution or any kind of compensation provided. Other restrictions may apply.
II. Phase 2 – Public Voting Top 20 Winners
A) Public Voting
All Top 100 Finalists’ Live Performance submissions from Phase One will be displayed online at https://truenorthtunesmusic.ca on Monday, July 6, 2026 at 1:00 p.m. EST and will be subject to online voting (“Public Voting”) process to determine the top 20 Artists (“Top 20 Finalists”). Once a member of the public has watched the Live Performance selected as part of the Phase One Curation round, an Eligible Voter (defined below) can place their vote directly on https://truenorthtunesmusic.ca Public Voting will begin on or around 1:00 p.m. EST Monday, July 6, 2026 and ends at 11:59:59 p.m. EST on Friday, August 7, 2026 ("Public Voting Period"). The Short List Finalists will be announced on Monday, August 24, 2026.
B) Eligible Voters and Process
To participate in the Public Voting process, you must be a legal resident of Canada and nineteen years of age or older (“Eligible Voter”). LIMIT: One (1) vote per person per calendar day (defined as 12:00:01 a.m. EST to 11:59:59 p.m. EST (a “Calendar Day”)).
All voting must originate at https://truenorthtunesmusic.ca during the Public Voting Period, and Eligible Voters must satisfy the follow criteria:
To register your vote, click the voting button on the Samsung True North Tunes website once a day.
Use of automatic voting software, artificial intelligence (AI), multiple email addresses or handles to vote multiple times per day, and/or activity deemed by the Sponsors to be contrary to the spirit of fair play as it relates to the Contest and public voting is strictly prohibited.
Sponsors will monitor all votes and have the right and at its sole discretion to disqualify votes for any of the following reasons:
- Exceeding a maximum of one (1) vote within one Calendar Day (EST);
- Inappropriate content;
- Trolling or spamming other contestants; or
- Any other behaviour as determined by the Sponsor to be a violation of the spirit of fair play as it relates to the Contest.
Only full and complete vote entries from https://truenorthtunesmusic.ca will be counted.
Any posts made pursuant to the Public Voting or during the Public Voting Period, by either a voter or Top 100 Finalist or Top 20 Finalist, may not be offensive or inappropriate and may not contain profanities or obscenities nor depict Contest Entities unfavorably, as determined by Sponsor, in its sole discretion. Public Voting must be consistent with the images of the Contest Entities and must not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or property rights or any other third party rights. Sponsors reserve the right in its sole discretion to disqualify any voter or Public Voting it determines does not comply with these requirements or these Official Rules, in its sole discretion.
During the Public Voting Period, Eligible Voters will be asked to vote for the entry that best exemplifies the originality and quality of the music content submissions from among those posted as part of the Music Experts Curation round. Voting will solely determine the Top 20 Finalists. Top 100 Finalists are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes, forced voting sessions, multiple email or other inducements to members of the public, as determined by Sponsors in their sole discretion. Use of script, macro artificial intelligence (AI), or any automated system to vote or with the intent to impair the integrity of the voting process is prohibited and all such votes will be void.
D) True North Tunes Short List Selection Criteria
The twenty (20) Top 100 Finalists with the most public votes at the end of the Public Voting Period, will be eligible to be declared Top 20 Finalists. In the event of a tie, a “tie-breaking” judge, to be selected by Sponsors in their sole and absolute discretion, will determine the potential Top 20 Finalists. The Top 20 Finalists will be awarded the Top 20 Finalists described below in these Contest Rules.
E) Phase Two Prizing
The Top 20 Finalists prizes (each a “Top 20 Finalist Prize”) available are listed in the table below:

| Artist Workshop | Small and intimate session (Toronto; 1 day) with music industry professionals that explore the business of music, marketing yourself as a musician, and chance for networking with Canadian Music personnel. For Top 20 Finalists who are not able to attend the Artist workshop in person in Toronto, they can attend the Artist Workshop virtually. |
IMPORTANT NOTE: IMPORTANT NOTE: All Top 20 Finalists must participate in the Live Performance in order to be eligible to participate as a Top 20 Finalist in Phase 3. By accepting the Top 20 Finalist Prize each Top 20 Finalist permits the Contest Entities (and any other party authorized by the Contest Entities) to capture an audio-visual recording of Artist during the Live Performance which may capture Artist’s name, image, voice, likeness, performance and any comments, statements or performances made by or attributable to Artist (the “Live Performance Video”). Further, each Top 20 Finalist acknowledges and agrees that they will have no right of approval of the Live Performance Video.
Travel and accommodations are NOT included with any Top 20 Finalist Prize. EACH TOP 20 FINALIST will also be responsible for obtaining his or her own travel documentation. EACH TOP 20 FINALIST must be available to travel on the dates assigned by the Sponsors for the live performance prize or the live performance prize will be forfeited IF THE TOP 20 FINALIST IS NOT ABLE TO TRAVEL ON THE DATES ASSIGNED BY THE SPONSORS. The Top 20 Finalist Prizes must be accepted as awarded without substitution and is not transferable, not for resale and has no cash surrender value. In the event that the Top 20 Finalist does not use any portion of the Top 20 Finalist Prize, there will be no extension, transfer, substitution or any kind of compensation provided. Other restrictions may apply.
III. Phase 3 – Grand Finale Winners
A) Public Voting
All Top 20 Finalists’ Live Performance Videos from Phase Two will be displayed online at https://truenorthtunesmusic.ca/ on Monday, August 24, 2026 at 1:00 p.m. EST as well as showcased on Samsung True North Tunes social media pages, and will take part in a second Public Voting process both on the Microsite and on social media to determine the Top 3 finalists (the “Grand Finale Winners”). Public voting will begin on or around 1 p.m. EST Monday, August 24, 2026 and ends at 11:59:59 p.m. EST on Wednesday, September 23, 2026 ("2nd Public Voting Period"). The Grand Finale Winners will be announced on Tuesday, October 13, 2026 at 1:00 p.m. EST.
B) 2nd Public Voting Period – Top 3 Eligible Voters and Process
To participate in the Public Voting process, you must be a legal resident of Canada and nineteen years of age or older (“Top 3 Eligible Voters”). Top 3 Eligible Voters who want to vote on social media may be required to create a corresponding social media account. LIMIT: One (1) vote per person per calendar day (defined as 12:00:01 a.m. EST to 11:59:59 p.m. EST (a “Calendar Day”)).
All voting must originate on the Microsite or Samsung True North Tunes social media channels during the 2nd Public Voting Period, and Top 3 Eligible Voters must satisfy the follow criteria:

Use of automatic voting software, artificial intelligence (AI), multiple email addresses or handles to vote multiple times per day, and/or activity deemed by the Sponsor to be contrary to the spirit of fair play as it relates to the Contest and public voting is strictly prohibited.
Sponsors will monitor all votes and has the right and at its sole discretion to disqualify votes for any of the following reasons:
- Inappropriate comment;
- Trolling or spamming other contestants; or
- Any other behaviour as determined by the Sponsor to be a violation of the spirit of fair play as it relates to the Contest.
Any posts made pursuant to the public voting or during the 2nd Public Voting Period, by either a voter or Top 20 Finalist, may not be offensive or inappropriate and may not contain profanities or obscenities nor depict Contest Entities unfavorably, as determined by Sponsors, in their sole discretion. Public voting must be consistent with the images of the Contest Entities and must not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or property rights or any other third party rights. Sponsors reserve the right in its sole discretion to disqualify any voter or public voting it determines does not comply with these requirements or these Official Rules, in its sole discretion.
During the 2nd Public Voting Period, legal residents of Canada will be asked to vote for the entry that best exemplifies the originality and quality of the music content submissions from among those posted. The 2nd Public Voting Period will solely determine the Grand Prize Winners. Top 20 Finalists are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes, forced voting sessions, multiple email or other inducements to members of the public, as determined by Sponsors in their sole discretion. Use of script, macro artificial intelligence (AI), or any automated system to vote or with the intent to impair the integrity of the voting process is prohibited and all such votes will be void.
C) Grand Prize Winners: Winners Selection Criteria
The Grand Prize Winners with the most public votes at the end of the Public Voting Period, will be eligible for the Grand Prize. In the event of a tie, a “tie-breaking” judge, to be selected by Sponsor, will determine the potential Grand Prize Winners. The Grand Prize Winners will be awarded described below in these rules.
C) Phase Three: Grand Prizes

For the Grand Prize Winners who are not able to attend the Beer & Music Release Party, they can attend the Artist Workshop virtually. Grand Prize Winners have the choice to not receive this Grand Finale Prize at their discretion. |

| Collective Arts Small Batch Beer (3) | Limited small-batch cans produced by Collective Arts featuring custom artwork celebrating the Grand Prize Winner. This is subject to execution of release and contractual documents provided by the Sponsors. Grand Prize Winners have the choice to not receive this Grand Finale Prize at their discretion. |
Travel and accommodations are NOT included with any Grand Finale Prize. EACH GRAND FINALE PRIZE will also be responsible for obtaining his or her own travel documentation. EACH GRAND FINALE PRIZE must be available to travel on the dates assigned by the Sponsors for the live performance and live studio recording prize or the live performance and the live studio recording prize will be forfeited IF THE GRAND FINALE WINNER IS NOT ABLE TO TRAVEL ON THE DATES ASSIGNED BY THE SPONSORS. The Grand Finale Prizes must be accepted as awarded without substitution and is not transferable, not for resale and has no cash surrender value. In the event that the Grand Finale Finalist does not use any portion of the Grand Finale Prize, there will be no extension, transfer, substitution or any kind of compensation provided. Other restrictions may apply.
6. Other General Rules
The Contest is governed by the laws of Canada, province of Ontario without regard its conflict of laws principles with venue in Toronto, Ontario Canada, and all claims must be resolved in the courts of Toronto, Ontario Canada.
As a strict condition of participating in the Contest, Eligible Participants agree; (a) to abide by these Official Rules, and to the decisions of Sponsors and the judges, which shall be final and binding in all respects; (b) to the publication, reproduction and/or other use of their names, cities of residence, statements about the Contest, likenesses, biographical data and all other Contest Assets, by Sponsors, all other Contest Entities and any other party authorized by the Contest Entities , for advertising, promotional and other purposes in any and all media now or hereafter known throughout the world for a period of two (2) years from the conclusion of the Contest at discretion of Sponsors without compensation, permission or notification (except where prohibited by law); (c) THAT CONTEST ENTITIES (collectively the “Released Parties”) SHALL HAVE NO LIABILITY AND SHALL BE HELD HARMLESS FOR ANY DAMAGE, LOSS OR INJURY TO AN ENTRANT OR ANY THIRD PARTY RESULTING FROM PARTICIPATION IN THIS SWEEPSTAKES OR THE USE OR MISUSE OF ANY PRIZE. PRIZES ARE AWARDED “AS IS” WITHOUT ANY REPRESENTATIONS OR WARRANTIES EXCEPT FOR ANY “IN THE BOX” WARRANTY THAT MAY BE PROVIDED WITH A PRIZE; (d) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT OF POCKET EXPENSES, IF ANY; (e) ALL CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS SWEEPSTAKES, OR ANY COMPENSATION OR CREDIT TO BE PROVIDED, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; AND (f) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARD SHALL BE LIMITED TO ACTUAL OUT OF POCKET COSTS INCURRED, IF ANY, AND IN NO EVENT SHALL ENTRANT BE ENTITLED TO RECEIVE ATTORNEYS’ FEES OR OTHER LEGAL COSTS OR EXPENSES.
Sponsors are not responsible for: (i) any damage to or loss of a prize that may occur as a result of or in the course of delivery of a prize, (ii) delivery of a prize within a reasonable or specified time, or (iii) any costs associated with the installation or assembly of a prize, if applicable.
By accepting a prize, each Eligible Participant agrees to release and hold harmless Released Parties from and against any damage, loss or injury resulting from the use or misuse of any prize or Released Parties’ use of any rights granted herein. Released Parties are not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed phone, computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, scoring errors or other problems or errors related to participation in the Contest or other errors or problems of any kind whether typographical, printing, human, mechanical, computer, electronic or otherwise relating to or in connection with the Contest, including, without limitation, errors or problems which may occur in connection with the administration of the Contest, the processing or judging of Entries, the tabulation of votes, the incorrect uploading of any video, the announcement of the prizes or in any Contest-related materials or for any damage to your or other person’s computer hardware or software as a result of participation.
Released Parties are not responsible for entries that are late, lost, stolen, incomplete, inaccurate, undelivered, misdirected, garbled or delayed by computer transmissions. Persons found tampering with or abusing any aspect of this Contest or who are in violation of these Official Rules as solely determined by the judges will be disqualified and all associated entries will be void. Every submission must be manually entered by the individual participant and repetitive automated electronic submission of entries is specifically disallowed. In the event the Contest is compromised by virus, bugs, non-authorized human intervention or other causes which corrupt or impair the administration, security, fairness or proper play of the Contest, or if Contest is unable to run as planned for any other reason, Sponsors reserve the right in its sole discretion to suspend or terminate the Contest or any portion thereof and/or terminate the participation of any participant (and void his/her entry) whose conduct potentially compromises the Contest and, if terminated, at Sponsors’ discretion, judge all eligible, non-suspect entries received up to time of such action using the applicable judging procedures outlined above.
In the event of a dispute regarding who submitted an entry, entries will be deemed to have been submitted by the authorized account holder of the telephone number submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned a telephone number by a telephone service provider or other organization (e.g. business, educational institute, etc.) that is responsible for assigning telephone numbers. You may be required to provide proof that you are the authorized account holder of the telephone number associated with the selected entry and that you have all necessary consents, permissions and/or licenses as required by these official Rules. The sole determinant of the time for the purposes of a valid entry in this Contest will be the Contest server machine(s). All entries are subject to verification by the Sponsor in its sole discretion. The Sponsors reserve the right, in its sole discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsors) to participate in this Contest. Failure to provide such proof in a timely manner may result in disqualification. You may also be required to provide proof that you are the contestant in respect of the selected entry. The Sponsor reserves the right, in its sole discretion, to disqualify any individual (and all of his or her entries) who tampers with the entry process. ANY ATTEMPT BY YOU OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND THE CONTEST SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
PERSONAL INFORMATION: The Sponsors are collecting personal information about you for the purpose of administering this Contest. Your personal information will be used for the administration of the Contest, including contacting selected contestants, the awarding of the prizes and in aggregated, non-personal form in order to create reports regarding contestant demographics and consumer habits, which reports the Sponsors may disclose to others. By entering this Contest, you consent to the collection, use, storage, sharing and disclosure by the Sponsors (and its officers, directors, employees, agents or representatives) of the personal information provided by you in Contest entries in accordance with the Sponsor #1’s privacy policy (available at http://www.samsung.com/ca/info/privacy.html
